Employee Complaint

Employee Complaint - Discrimination, Harassment or Retaliation

 

The State of Arizona is committed to protecting its employees from unlawful discrimination, harassment, and retaliation. Every state agency has a procedure to address employee complaints concerning harassment or discrimination and an employee within the agency who has been designated to serve as the agency’s complaint coordinator.

 

An employee may use their agency’s complaint process to file a complaint alleging:

  • Unlawful discrimination based on race, color, religion, sex (including pregnancy), age, national origin, genetic information, or on the basis of a disability
  • Sexual harassment or other form of harassment
  • Retaliation for filing a complaint
  • Retaliation or intimidating for exercising any right under state or federal law
     

Complaint Procedures
Because each agency has its own complaint procedures, it is important to review your specific agency’s policy and procedure; however, every agency policy will include the following:

 

Complaint Requirements: the complaint must be filed with the agency’s complaint coordinator within 180 days of the action giving rise to the complaint, and must clearly outline the allegations to be addressed.

 

Review of Complaint: upon receipt of the complaint, the agency complaint coordinator shall initiate an investigation into the alleged complaint or assign the complaint to the appropriate individual within the agency for review or investigation.

 

Response from the Agency Head: the agency head, or designee, will issue a written decision to your complaint.

 

Ability to Elevate the Complaint to the Arizona Department of Administration (ADOA): an employee who is not satisfied with the agency head’s response to a complaint may, within five business days after receipt of the agency head’s response, elevate the complaint to the ADOA Director.
